Terms and Conditions for the Purchase of a Grounded and Rise Hypnobirthing Course

These Terms and Conditions govern the booking and attendance of hypnobirthing courses provided under the trading name Grounded and Rise, a trading name of E. OD HEALTHCARE LTD (“we”, “us”, “our”). By booking a course, you agree to these Terms and Conditions.

1. About Us

Grounded and Rise is a trading name of E. OD HEALTHCARE LTD.

Our courses provide evidence-informed antenatal education, relaxation techniques, and hypnobirthing tools to support preparation for labour and birth.

Although the course is taught by a registered nurse, it is provided for educational purposes only and does not constitute medical advice, diagnosis, or treatment. Participation in the course does not create a healthcare professional–patient relationship.

You should always seek advice from your midwife, GP, obstetrician, or other qualified healthcare professional regarding your pregnancy and maternity care.

2. Booking and Payment

Your booking is confirmed once full payment has been received, unless a written payment plan has been agreed.

Where a payment plan is agreed:

All instalments must be paid on the agreed dates

Failure to make payments may result in suspension or cancellation of your booking

You remain liable for the full course fee

All prices are stated in pounds sterling (£).

3. Consumer Cancellation Rights

If you book online, by telephone, or by email, your booking is a distance contract and may be subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You normally have a 14-day statutory right to cancel.

However, if:

you request that the course begins within the 14-day cancellation period, and

you acknowledge and agree that the service may begin within this period,

you acknowledge that you may lose your right to cancel once the service has begun, in accordance with applicable law.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

4. Refund and Cancellation Policy

All cancellations must be made in writing via email.

A full refund will be provided if you cancel at least 72 hours before the course start time

If you book within 72 hours of the course start time, or cancel within this period, refunds will be considered at our discretion

Once the course has commenced, refunds will not normally be issued unless required by law

Where a refund is required under consumer law, this policy does not limit your statutory rights.

5. Transfer of Bookings

You may request to transfer your booking to a future course date.

Transfers are subject to availability

Requests should be made as early as possible

One transfer may be offered at our discretion

Additional transfers may incur an administration fee or require a new booking

6. Birth Before Course Completion

If your baby is born before you begin or complete the course, please contact us as soon as possible.

Where appropriate, we may offer (at our discretion):

transfer to another course

a catch-up session

alternative learning materials (where available)

another reasonable solution agreed between both parties

7. Course Delivery

Courses are delivered live online via Zoom or a similar platform.

Participants are responsible for ensuring they have:

a stable internet connection

a suitable device

an appropriate environment for participation

Joining instructions will be provided prior to the course.

8. Missed Sessions

If you miss a session, refunds are not normally available.

Where possible, we may offer a recording or catch-up option, but this cannot be guaranteed.

9. Course Materials and Intellectual Property

All course materials remain the intellectual property of Grounded and Rise and E. OD HEALTHCARE LTD.

Materials are provided for personal, non-commercial use only.

You must not:

copy, reproduce, or distribute materials

record live sessions without written permission

share materials with third parties

use materials for teaching or commercial purposes without consent

10. Medical Disclaimer

The course is educational and designed to support understanding of labour and birth.

It is not medical advice and must not replace care or guidance from your healthcare professionals.

If you have concerns about your pregnancy or labour, you should seek medical advice promptly.

11. No Guarantee of Outcomes

Every pregnancy and birth is unique.

We do not guarantee any specific outcome, including labour experience, pain relief, or mode of delivery.

12. Participant Responsibilities

Participants agree to:

behave respectfully at all times

respect confidentiality of other participants

not attend under the influence of alcohol or illicit substances

continue appropriate maternity care throughout pregnancy

We reserve the right to remove any participant whose behaviour is disruptive, abusive, or inappropriate. In such cases, refunds will not normally be issued.

13. Privacy

Personal data will be used only for course administration and communication.

We process data in accordance with UK data protection law.

14. Limitation of Liability

Nothing in these Terms excludes liability where it would be unlawful to do so, including:

death or personal injury caused by negligence

fraud or fraudulent misrepresentation

any liability that cannot legally be excluded

Otherwise, our liability is limited to the amount paid for the course.

We are not liable for indirect or consequential losses.

15. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including illness, internet outages, severe weather, pandemics, government restrictions, or other unforeseen events.

Where possible, sessions will be rearranged or rescheduled.

16. Changes to Courses

We reserve the right to make reasonable changes to course content, structure, timing, or delivery.

Where significant changes occur, we will notify participants as soon as reasonably possible.

17. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
